Orders

All orders are subject to acceptance and product availability. Product pricing is correct at the time of entering the information. However, we reserve the right to change prices without prior notice. For Delivery and Returns details, please see our Help section.

Availability of Goods

All 'In Stock' items are usually despatched within 24 hours and orders placed before 3pm are despatched the same day. In the unlikely event that they are temporarily unavailable, every effort is made to get the product sourced. In any event, we do not charge your credit card until the date your order is despatched out to you.

Your Undertakings and Warranties

You warrant that the information given on your order form is complete and accurate. Losses caused as a direct result of inaccurate information provided (e.g. inaccurate address) remain your responsibility and risk. Please complete orders carefully!

Acknowledgement of Order

When you have completed the order, your details will be confirmed as part of the payment process prior to despatch. This confirmation will state what the products are, the cost (including VAT and any P&P) and delivery and invoice details. If your order has been unsuccessful, you will be made aware of the reason why and possible explanations. Please note that when you place an order, SimplyGames will acknowledge it, but reserve the right to notify you if the price has been incorrectly featured, and amend the charge to you accordingly. Should you not wish to proceed with the transaction at the new price your order will be cancelled and you will incur no charge.

Payment

All credit and debit card holders are subject to validation checks and authorisation by the card issuer. If the issuer of your payment card refuses to authorise payment to us, we will not be liable for any delay or non-delivery. We reserve the right to cancel any order.

Returns

Limitation of Liability

Subject to any relevant consumer protection legislation, including our obligation under the Consumer Protection (Distance Selling) Regulations to give you a refund, if we do not perform the contract within 30 days or other agreed timescale our liability for any breach of these terms and conditions shall be limited to the value of the goods ordered by you in the relevant transaction, and in certain circumstances the postage cost.

5. Children

Where you have a SimplyGames account, your account will remain active for twelve months from date of purchase, after which time all of your information will be removed from our system.
